Copyright: Registration and Fixation

Copyright is an important right in the field of intellectual property. Copyright makes it possible to protect a wide range of subjects, such as computer software and applications, images, literary works, artistic works, and dramatic and musical works. In the modern world, where the internet has gained momentum and new and original applications and software are published every day, alongside of course traditional works, protecting copyright can be an important component of a new or established venture.

In Israel, in principle, copyright is protected without registration, but the problem in many cases is proving fixation. It is therefore sometimes preferable to fix the copyright in a way that provides solid proof and evidence, making it relatively easy to prove that the copyright indeed existed at a given date.

Our firm handles the process of fixing copyright, both by preparing an affidavit and by filing for registration in other countries. For example, we file the application in the USA and receive confirmation of the filing.

Copyright in What?

The Copyright Law, 5768-2007, regulates the protection of the copyright right. Copyright in a work is the exclusive right to perform, in the work or in a substantial part of it, one or more acts as detailed in the law, which vary according to the type of work.

For example, copying for all types of works, publication for an unpublished work, public performance in certain cases for certain types of works, or rental for a sound recording, a cinematographic work and computer software.

Our firm supports entrepreneurs and companies in protecting their copyright, whether already published or not yet published, in Israel and abroad. We also prepare agreements for the transfer of copyright; for example, it is sometimes necessary to transfer ownership of copyright, for instance from the application developer (as a contractor) to the party who commissioned the application, i.e. the entrepreneur.

It is important to consult an attorney on this matter. The above information is partial and incomplete, and an attorney should be consulted on each specific case individually.
