A registered Israeli patent can be registered in the name of an Israeli inventor or an Israeli company, or of an inventor or company from outside of Israel that filed and received a registered patent in Israel. An Israeli inventor who wishes to protect his invention outside of Israel must file an application with the patent offices and patent authorities outside of Israel and request to register a patent in the target countries in which he wishes to protect his invention.
Registered Patent vs. Patent Pending
Registered patent vs. patent pending: there is a difference between the rights of a registered patent and the rights of a pending patent.
The inventor who filed first can request, in additional countries in which he files a patent application, if he files his application before 12 months have passed, that the priority date be recognized. In this way, he will prevent competitors from “seizing his invention”, known as FIRST TO FILE.
In addition, 18 months after the filing date, the application will be published, even if a patent has not yet been granted. After the patent is granted, the inventor can approach the infringer who infringed the patent and, in certain cases, claim compensation retroactively for the time when the application was still at the patent pending stage and not a registered patent.
Registered patent: a registered patent confers a right of action against another person who exploits an invention without the permission of the patent owner. It is possible to sue for compensation and request an injunction to stop the distribution and sale of the product that infringes the invention protected by a registered patent.
Our firm handles the preparation of material for a patent application, i.e. preparing drawings and drafting the patent application, and we file the application with the Israel Patent Office or outside of Israel in dozens of countries, where we work with local associates who handle the internal procedure in each country according to its domestic law and regulations.
In the patent registration process in Israel we usually exchange documents with the examiner. The examiner issues an examination report and we usually respond to it in writing, or we schedule an interview with the examiner if necessary.
After the examiner agrees with the wording we requested, he issues a notice of acceptance, and the Patent Office will then issue a patent certificate.
