Patent Registration

Patents are a field of intellectual property. Our firm handles patent registration processes from the conceptual stage and supports the inventor or the company in the patent drafting process in Israel and abroad. Our team has experience both in patent registration processes and in other legal proceedings related to patent drafting and intellectual property rights, conducted before the Israel Patent Office and patent offices around the world.
Patent registration is a legal right that grants a monopoly over an invention or a process. The patent application is a kind of claim filed with the various patent authorities around the world. The last section of the patent application specification is called the claims (claims), and it determines the scope of protection that the patent will grant.

Our attorneys and patent attorneys (responsible for patent drafting) draft the patent registration application filed with the various patent authorities around the world, and discuss the scope of protection with the patent examiners at a later stage, after the examination of the patent application.

Patents: How Do You Start?
If the inventor has an idea or an invention, or sometimes is at a more advanced stage, we meet with him and hold a brainstorming session with members of our team who are experts in patent drafting. Sometimes, when the inventor has only an idea that is not yet an invention, the idea needs to be turned into an invention, so that we can examine whether a patent registration application can be filed, i.e. whether there is a chance of obtaining a registered patent.

After an initial introductory meeting, if it appears that there is a chance of proceeding with a patent registration application, only then do we give our quote for preparing the material for the patent application, which consists of the drafting and legal wording and the preparation of drawings and illustrations in the appropriate format according to the Patents Regulations.

Patent Drafting: The Patents Law, What is a Patentable Invention?
Section 3 of the Patents Law states what a patentable invention is: “An invention, whether a product or a process in any field of technology, which is new, useful, can be applied industrially and involves an inventive step – is a patentable invention.” (emphasis not in the original).

In the first introductory meeting with the inventor, we examine, from a legal perspective, whether there is a chance of meeting the threshold conditions of the Patents Law. Of course, there are additional conditions that a patent registration applicant must meet in order to obtain a registered patent, but Section 3 of the Patents Law sets out the main substantive conditions.

It should be remembered that a patent registration application is one right in the field of intellectual property. Sometimes we recommend filing a patent together with applications for other intellectual property rights, or refraining from filing a patent application and saving the expenses involved.

Patent Term
The term of a patent is 20 years from the date the patent registration application was filed, with exceptions, for example in the case of a request for extension of the term in certain fields. After an examination carried out by a patent examiner of the Patent Office, who decides whether a particular invention will receive a registered patent or not, or will be accepted in part, the Patent Office will issue a notice of acceptance of the patent.

After receiving the patent certificate, the applicant in effect obtains the monopoly right over the invention as defined in the claims of the registered patent. The applicant must pay renewal fees every few years in order to keep the right granted by the registered patent in force.

The above information regarding patent registration and drafting is partial and incomplete. An attorney or patent attorney should be consulted on each specific case. We will be happy to help you advance your invention. Call: +972-3-9711013.
