Accelerated Patent Examination in Israel and Worldwide

Accelerated patent examination in Israel and worldwide is possible and depends on the intellectual property management strategy. There are cases in which there is a legal, business, technical or other need and benefit in accelerating the response of the patent authorities, and there are cases in which the inventor prefers to postpone the dates of receiving a response or to leave the examination process on the regular track.

After a specific review with the inventor, our firm outlines possible ways to receive fast responses from the patent authorities in Israel and abroad. If the route of accelerated examination suits the inventor economically, commercially and legally, there are advantages as well as disadvantages to this route.

Accelerated Patent Examination in Israel
The Patents Law states that it is possible to file for acceleration, or more correctly in legal language, expedited examination. An applicant can request to advance the examination under Section 19A of the Patents Law: “An applicant who has reasonable grounds for this may submit to the Registrar a reasoned request, accompanied by an affidavit in support of the facts, for the expedited examination of the application…”

The conditions for receiving a fast and accelerated examination are the payment of a fee and the preparation of a reasoned request accompanied by an affidavit that must be signed before an attorney or patent attorney. However, it is not enough to pay the fee alone; facts and reasonable grounds must be stated in order for the Israel Patent Office to approve the advancement of the examination.

Our firm handles the preparation of requests supported by an affidavit for advancing and accelerating the examination. We examine the facts together with the applicant, and as of 2015, we are happy to say that all of the acceleration requests we filed for our clients were approved.

A request for accelerated examination makes it possible to receive the first examination report within a short time of about one to four months or more. If there are corrections that must be answered to the examiner regarding the examination report, the examiners’ responses are also usually shorter compared to a case in which no acceleration request is filed.  An application without acceleration may sometimes be examined within about two to four years or more.

Accelerated Patent Examination in the USA and Other Countries

Accelerated patent examination is possible in the USA and in other countries. The practice of our firm, if the strategy of the inventor and the owner of the invention is to advance the examination of patents in Israel and in other countries around the world, is first to file an acceleration request in Israel, as described in the previous paragraphs.

After acceptance of a patent in Israel, we turn to the process of filing patents in countries with which Israel has signed an agreement. The PPH agreement makes it possible to advance the examination in the USA and in other countries. That is, for a patent accepted in Israel, after acceptance we will file applications outside of Israel and receive a fast response from the USA and other countries.

There is a procedure set out in the agreement regarding the steps required to receive acceleration outside of Israel, which our firm handles.

Sometimes, by building a strategy for obtaining patents quickly in Israel and worldwide, it is possible to obtain patents in Israel, the USA and other countries within a relatively short time. For example, in Israel we succeeded in receiving a notice before acceptance within one month of filing, and in the USA within about three and a half months.

If you have already filed a patent application and wish to receive a fast response, or if you wish to file a patent with acceleration and receive a fast response, contact our firm.
