It is not enough that an invention filed with the patent office may be suitable for the fast green track. The Israel Patent Office will not examine the application on the fast green track without a detailed and reasoned request asking for the green accelerated examination track.
Our firm handles the preparation of green track requests, preparing an appropriate request with the grounds for why a particular invention is suitable for the fast green examination track.
A Fast Examination Track by Acceleration or a Green Application
An applicant for patent registration can request a fast examination outside the regular examination track via two tracks: one is a request for acceleration and the other is a green application.
A request for acceleration requires an additional fee and the preparation of an affidavit with reasonable grounds as to why the inventor requests that his patent application be examined before those of other patent applicants, “shortening the examination queue” in his case.
A green application explains the grounds that exist in the invention, and no fee is required if the application is suitable for the green fast examination track.
When we draft a patent application with a reasoned request to advance the examination on the ground of a green application, we attach the reasoning for the green track request to the patent specification and to the drawings filed.
The application is transferred to an examiner who first examines the request for green accelerated examination. If it is approved, a notice is usually received from the Office that the application has been approved for green fast track examination, and it is transferred, in many cases, to another examiner for the substantive examination of the patent registration application.
