Our firm has lawyers, and lawyers who are also patent attorneys, and we handle various requests and hearings before the Registrar of Patents and before intellectual property adjudicators, whether in preparing documents and pleadings or in hearings in person before the Registrar of Patents’ tribunal.
Below are several examples from the Patents Law of cases that may lead to a hearing before the Registrar of Patents’ tribunal:
For example, in the patent examination process, the applicant argues that an examiner’s decision is wrong, or does not accept the patent examiner’s position. In such a case, under Section 161 of the Patents Law, it is possible to appeal the examiner’s decision: “Any decision or action of an examiner may be appealed, and it may be demanded that the matter be brought before the Registrar.”

For example, an opposition to the grant of a patent, on various grounds set out in the law, for example: there is a reason on account of which the Registrar would have been authorized to refuse the acceptance of the patent application; the invention is not patentable under Section 4(2); the opponent, and not the applicant, is the owner of the invention.
For example, in cases of naming the inventor in a patent application, under Section 39 of the Patents Law: “An inventor for whose invention a patent was applied for, or his heirs, may demand that the inventor’s name be stated in the specification, in the Register and in the patent certificate, and the Registrar shall comply with the demand subject to the provisions of Sections 40-41, provided that the demand was submitted at the time and in the manner prescribed.”
For example, restoration of a patent that lapsed due to non payment of a fee, under Section 59 of the Patents Law: ” The owner of a patent whose validity lapsed due to non payment of a renewal fee may request the Registrar, in the manner and form prescribed, to restore the validity of the patent, provided that upon filing the request he pays the special fee prescribed for this purpose (hereinafter – a request for restoration).”
For example, an opposition to the restoration of a patent, under Section 61 of the Patents Law: “Any person may oppose a request for restoration within three months from the date of publication, on the ground that the Registrar had no basis for ordering the publication of the request.”
For example, amendment of a granted patent, under Section 65 of the Patents Law: “The owner of a patent may request an amendment of the patent specification for the purpose of clarification or removal of an error in it, or for the purpose of narrowing its claims.”
For example, revocation of a patent not at the request of the patent owner, under Section 73B of the Patents Law: “The Registrar may, at the request of any person who is not the owner of the patent, revoke a patent if he found that there is a ground on which the grant of the patent could have been opposed; the laws of prescription shall not apply to a request for revocation under this section.”
